AB OBJECTIVE: Introduce projects to improve existent laws or establish new
sanitary regulations to affront efficiently the STD/AIDS problem under
strict consideration of Human Rights. METHOD: We thoroughly examined:
Venezuelan legislation that regulates infecto-contagious illnesses with
analogy in HIV/AIDS; specific legislation on HIV/AIDS of other
latinamerican countries; directrics of the National AIDS Programme.
RESULT: We found out that the majority of health regulations related to
infecto-contagious illnesses obey to anachronic laws that violate Human
Rights; that existent legislation and specific regulations on HIV/AIDS
are governed by a compulsive and discriminatory character; and the
nessecity of global reformation of existent health legislation.
DISCUSSION AND CONCLUSIONS: It is imperative to modernize the existent
health legislation in order to assure a balance between collective and
individual interest. Certain situations, however, as for example
limitation of application of antibody tests, should be regulated
specifically in order to avoid violation of Human Rights.
